Privacy Policy

This privacy notice applies to Ella Software, LLC ("Ella," "we," "us," or "our"), a Delaware limited liability company, and describes how we collect, use, and protect information when you use our services, including ella.kids (our marketing site), ellakids.app (our tool), and any other domains we operate.

1. Who We Are

Ella is an AI-powered tool that helps adults create visual supports for the children and students they support. Users can create visual supports, including stories, visual schedules, picture cards, worksheets, games, and strips. Users may create or select a character image for use in those materials.

Ella is for adult users, including professionals, parents, guardians, and caregivers. Children and students do not have accounts on Ella and do not directly interact with the tool. Visual supports created using Ella are intended for printing or display by an adult.

Our users include:

  • Special education teachers and school staff
  • Occupational therapists, speech-language pathologists, and ABA practitioners
  • Parents and guardians
  • School administrators

Ella's services are hosted in the United States and are intended for users located in the United States. Ella does not target or offer its services to individuals in the European Economic Area or the United Kingdom.

2. What Information We Collect

We collect only what is necessary to provide our service.

Information you provide

  • Account information: Your email address is collected when you register or sign in. If you sign in via Google or Microsoft, we may also receive your first and last name, your verified email address, and a profile image URL from those providers. We use this information only to create and display your account profile.
  • Content you create: Your prompts, character configurations, and visual support materials are associated with your account. To personalize a visual support, you may optionally provide a first name or identifier (for example, "D"), age, gender, or a written physical description for a character image. Character images are generated from written descriptions. You may also select a default character image instead of providing a description.
  • Photos: You may optionally upload photos of places or objects for use in a visual support. Ella's photo-upload feature is intended for photos of places and objects, and users are instructed not to upload photos of children or other identifiable individuals. Uploaded photos are stored in connection with your account.
  • Billing information: If you subscribe to a paid plan, payment details are processed by our payment provider. We do not store full card numbers.
  • Communications: If you contact us, we retain the content of those messages.

Information collected automatically

When you use Ella, we automatically collect certain technical information, including:

  • IP address and approximate location (country or region)
  • Browser type and version
  • Device type and operating system
  • Pages viewed, features used, and timestamps
  • Referring URLs

This information is used for security, performance monitoring, and improving our service. It does not reveal your specific identity on its own.

What we do not collect

Ella does not require or request IEP documents, academic performance data, evaluations, diagnoses, disciplinary records, or other detailed student records, and Ella has no feature for uploading them. Ella does not support photo uploads of children or other identifiable individuals. No student has a direct account or any direct interaction with our tool.

Users may optionally provide limited personalization details — such as a first name or initial, age, gender, or a written physical description — as described above. When those details are submitted by a school or district user, Ella treats them as customer data under Section 8.

3. How We Use Your Information

We use the information we collect to:

  • Create and maintain your account
  • Deliver the Ella tool and generate visual supports based on your inputs
  • Process payments and manage your subscription
  • Respond to support requests and inquiries
  • Send transactional communications related to your account (billing notices, password resets)
  • Send product updates and marketing communications, where you have not opted out
  • Monitor for fraud, abuse, and security threats
  • Improve and develop Ella's features and performance, using aggregated and de-identified usage metrics such as feature usage counts, performance data, and error rates. We do not use your prompts, character details, uploaded photos, or generated content to train or fine-tune AI models, and we do not permit our AI providers to do so
  • Comply with legal obligations

Ella does not use information about a child for any purpose other than generating and storing the requested visual support, and never for advertising, profiling, or model training.

4. How We Share Your Information

We do not sell your personal information. We share data only in the following circumstances.

Service providers and sub-processors

Ella uses third-party service providers ("sub-processors") to deliver certain functions of the platform, including cloud hosting, AI content generation, and payment processing. All sub-processors are contractually bound to handle data only as necessary to perform their services and to comply with applicable privacy laws.

Ella limits what is transmitted to AI sub-processors to the content necessary to generate the material you request: your prompt, any character details you choose to provide, and any photos of places or objects you upload. Ella does not transmit account credentials, email addresses, billing information, or account-profile data to any AI sub-processor. Other sub-processors, such as our cloud hosting and payment providers, receive only the data necessary for their specific function, as described in our sub-processor list. Ella accesses its AI providers under enterprise or developer API terms that prohibit the use of Ella customer content for model training or model improvement. See our AI Policy for further detail.

Ella publishes a current list of its material sub-processors, including their functions and applicable processing locations, at ella.kids/subprocessors. You may also request a copy at hello@ella.kids. School and district customers may subscribe to advance notice of material changes to sub-processors by emailing hello@ella.kids, or as otherwise provided in their agreement with Ella.

Legal and safety disclosures

We may disclose information if required by law, court order, or government request, or when we believe disclosure is necessary to protect the safety of any person or to enforce our terms.

Business transfers

If Ella is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such transfer and of any material change to how your information is handled. Any data processed under a school or district agreement will remain subject to the commitments in that agreement.

5. Cookies and Tracking Technologies

We use cookies and similar technologies to support account authentication, maintain session state, and collect usage analytics. You can configure your browser to refuse cookies, though some features of the tool may not function properly if you do.

We do not use cookies to serve targeted advertising.

Opt-out preference signals. Because we do not sell personal information, share it for cross-context behavioral advertising, or engage in targeted advertising, opt-out preference signals such as Do Not Track and Global Privacy Control have no effect on our data practices. If our practices change, we will honor Global Privacy Control signals as required by applicable law.

6. Data Retention

Your account data is retained for as long as your account is active. If your account remains inactive for twenty-four (24) consecutive months, we may delete your account and associated content after sending advance notice to your account email address. This inactivity policy does not apply to accounts governed by an Institutional Agreement, where retention is governed by that agreement.

For data processed under a school or district contract, Ella will return or delete applicable customer data within thirty (30) days after contract termination or a verified written request, unless a different period is required by the applicable agreement or law. Ella will provide written confirmation upon request.

Residual copies may remain temporarily in access-restricted disaster-recovery backups. Backups are retained on a rolling cycle and are overwritten in the ordinary course. Backup data is not used for ordinary business purposes and, if restored, remains subject to the applicable deletion request.

We may retain limited records as necessary to comply with legal, tax, or accounting obligations, resolve disputes, or enforce our agreements.

7. How We Protect Your Information

We employ industry-standard security measures to protect your data, including:

  • Encryption at rest: AES-256 encryption for all database instances and storage
  • Encryption in transit: HTTPS and TLS 1.2+ for all communications between your browser and Ella's systems
  • Access controls: Role-based access control (RBAC) and mandatory multi-factor authentication (MFA) for all internal administrative systems
  • Network security: Firewalls and AWS security groups restrict access to production systems
  • Monitoring: Centralized logging and monitoring tools detect anomalous behavior
  • Incident response: Ella maintains a documented incident-response plan. Ella will notify affected users and customers without unreasonable delay following confirmation of a security incident affecting their data, consistent with applicable law and the terms of any applicable data privacy agreement.

Ella conducts periodic internal security reviews. Despite these measures, no system is completely immune to risk. We encourage you to use a strong, unique password and to access Ella only from secure environments.

8. FERPA, COPPA, and K–12 Use

Ella is an adult-facing service. Students do not create accounts, log in, or directly interact with the service. Ella does not require IEP documents, academic records, diagnoses, or other detailed student records to provide its core functionality.

Authorized adult users may choose to submit limited student-related information — such as a first name or initial, age, gender, or a written physical description — to personalize visual supports. Where a school or district designates Ella as a school official with a legitimate educational interest under FERPA, Ella will perform an institutional service that the school would otherwise perform itself, will remain under the direct control of the school or district with respect to the use and maintenance of any education records, and will process that information only to provide, maintain, secure, and support the contracted service and as directed by the school or district. Ella does not use that information for advertising or AI-model training, and does not re-disclose it except as permitted by the applicable agreement or required by law.

Ella is not directed to children and does not knowingly permit children to create accounts or interact with the service directly. Ella does, however, permit adult users to enter limited information about a child to personalize a visual support.

Where an adult user is acting on behalf of a school or district, Ella relies on the school or district to provide consent on behalf of parents for the collection and use of that limited information, consistent with the school-consent framework under COPPA, and to have provided any notice to parents required by its own policies or applicable law. Ella's use of that information is limited to providing the requested educational service and is never used for advertising, profiling, behavioral targeting, or model training.

Ella requires each user acting on behalf of a school or district to represent that they are authorized to submit such information and that their institution has provided any consent or notice required under applicable law. Ella relies on that representation. Schools and districts may contact hello@ella.kids at any time to review, obtain a copy of, or request deletion of information submitted by their users.

Where an adult user is a parent or guardian, that user provides consent directly by choosing to enter the information.

Retention of children's information. Information about a child that a user enters to personalize a visual support is retained only as long as needed to provide and store the requested visual support, and is deleted when the user deletes the associated content or account, or in accordance with the retention periods described in Section 6. Ella does not retain children's information indefinitely and does not use it for any secondary purpose.

If Ella learns that a child directly submitted personal information without appropriate authorization, Ella will take reasonable steps to delete it promptly.

Ella does not use information about a child for any purpose other than generating and storing the requested visual support, and never for advertising, profiling, behavioral targeting, or model training.

Ella will comply with applicable school or district agreements and applicable student-privacy requirements. Where Ella has entered into a data privacy agreement, student data privacy addendum, or similar written agreement with a school or district, the terms of that agreement govern Ella's handling of data covered by it and control over any conflicting term in this Privacy Policy.

Schools and districts may contact hello@ella.kids to request Ella's district-level data privacy agreement or to discuss an applicable state Student Data Privacy Consortium agreement.

9. Your Rights and Choices

You have the following rights with respect to your personal information:

  • Access: You may request a copy of the personal information we hold about you.
  • Correction: You may request that we correct inaccurate or incomplete information.
  • Deletion: You may request deletion of your account and associated data by emailing hello@ella.kids from the address associated with your account. An authorized agent may also submit a deletion request on your behalf as described below.
  • Opt out of marketing: You may unsubscribe from marketing emails at any time using the unsubscribe link in any email, or by contacting us directly. You will continue to receive transactional messages related to your account.
  • Data portability: You may request a copy of your data in a commonly used, machine-readable format. This statutory right applies regardless of your plan tier or any in-product export limitations described in our Terms of Service.

We will respond to verified requests within 45 days, or sooner where required by applicable law. We may extend this period once by an additional 45 days where permitted, and will notify you of the extension and the reason for it. To submit a request, email hello@ella.kids.

Authorized agents. You may designate an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and may require you to verify your identity directly with us before processing the request.

No discrimination. We will not discriminate against you for exercising any of these rights, including by denying you goods or services, charging you a different price, or providing you a different level or quality of service.

Where your data is processed on behalf of a school or district, we may direct your request to that institution.

10. U.S. State Privacy Rights

Residents of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws may have rights to know what personal information we collect, to access, correct, delete, or obtain a portable copy of that information, and to opt out of the sale of personal information, targeted advertising, and certain profiling. Retention periods for each category are described in Section 6.

We do not sell personal information, share it for cross-context behavioral advertising, use it for targeted advertising, or engage in profiling that produces legal or similarly significant effects.

The categories of personal information we collect are described in Section 2 and include identifiers (email address, name) and internet and device activity data. Optional content you enter to personalize a visual support may reveal information about a child, including information that may indicate a disability status or health-related condition, which is treated as sensitive personal information under some state laws. Ella collects such information only where a user chooses to provide it, uses it solely to generate and store the visual support you requested, and does not use or disclose it to infer characteristics about individuals, for targeted advertising, or for any purpose unrelated to providing, securing, and supporting the service.

Where a user chooses to enter such information, they do so voluntarily and represent that they have any authorization required to share it. We do not use or disclose sensitive personal information for any purpose other than providing the service you requested, and we do not sell or share it. California residents may direct us to limit the use of sensitive personal information by emailing hello@ella.kids.

Appeals. If we deny your privacy request, you may appeal by replying to our response or emailing hello@ella.kids with the subject line "Privacy Request Appeal." We will respond to appeals within 45 days. If your appeal is denied, you may contact your state attorney general to submit a complaint.

11. Service Location

Ella's services are hosted and operated in the United States and are intended for users located in the United States. Ella does not target or market its services to individuals in the European Economic Area, the United Kingdom, or other jurisdictions outside the United States. If you access Ella from outside the United States, you do so on your own initiative and are responsible for compliance with local law, and you understand that your information will be transferred to and processed in the United States.

We may update this policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. If we make material changes, we will notify you by email or by posting a prominent notice on our website. We encourage you to review this policy periodically.
